Be it Remembered, That heretofore, to wit on the         27th day of

        April         in the year of our Lord one thousand eight hundred and

        seventy,         Hiram King one of the                 ,

Executors, named in the Last Will and Testament . of Luke English         , late of the Town of Chenango         , in County of         Broome         , deceased, appeared in open Court, before the Surrogate of the County of         Broome         , and made application to have the said Last Will and Testament . which relates to both Real and Personal Estate, proved : and on such application the said Surrogate did ascertain by satisfactory evidence who were the         widows         heirs at law and next of kin of the said testator, and their respective residences,        

and said Surrogate did thereupon issue a Citation in due form of law, directed to the         widows         heirs at law and next of kin , by their respective names, stating their respective places of residence                                 . requiring them to appear before said Surrogate at

                his office         , in the         City         of

        Binghamton         , in said County, on the         9th day of

        May         A. D. 1870 . to attend the Probate of said Will,

And afterwards, to wit: on the 9th day of May , ,

A .D., 1870,satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day no one appearing to oppose the Probate of such Will . such proceedings were thereupon had in

said Court afterwards, that the said Surrogate took the proofs of said Will ,

, hereinafter set forth, upon this 9th day of May ,

A. D., 1870, and he thereupon adjudged the said Will ,

To be a valid Will , of Real and Personal

Estate, and the proofs thereof to be sufficient, which said Last Will and Testament

, and proofs, are as follows, that is to say:

In the name of God, Amen. I Luke English of the town of Chenango, County of Broome, and State of New York, being of sound mind and memory, and considering the uncertainty of the frail and transitory life, do herein make, ordain, publish and declare this to be my last Will and Testament. That is to say: ,

First. – Alter all my lawful debts are paid and discharged, I give and bequeath to my Grandson George English, Fifty- Dollars… .

Second, I give and bequeath to my Grandson Levi English, Fifty Dollars… .

Third, I give and bequeath to my Grandson Francis English, Fifty Dollars… .

Fourth, I give and bequeath to my Grandson Luke English, Fifty Dollars… .

Fifth, I give and bequeath to my Grandson Adelbert English, Fifty Dollars… .

Sixth, I give and bequeath to my Grandson John Kinyon, Fifty Dollars… .

Seventh, I give and bequeath to my Grand Daughter Elizabeth Rogers, Fifty Dollars…. .

Eighth, I give and bequeath to my Grand Daughter Jane Kinyon, Fifty Dollars… ,

Nineth, I give and bequeath to my friend Hiram King, Fifty Dollars… .

Tenth, I give and bequeath to my friend George King, Twenty Five Dollars… .

Eleventh, I give and bequeath to my son in law John W. Kinyon, Fifty Dollars… .

Twelpth, I give and bequeath to my Daughter Fanny Kinyon, my house and lot which is at this time my homestead and bounded and described as follows. All that tract or parcel of land situated in the town of Chenango, County of Broome and State of New York being part of lot over one hundred and twenty acres in the Grand Division of the Boston town so called. Beginning at the stake at the highway leading from Chenango Forks Westerly called the Mix road, thence, 18 degrees East Eight over to the stake, thence north 72 degrees East one hundred feet, thence north 18 degrees West Eight rods, thence south 72 degrees West one hundred feet to the fence of beginning, being the same price conveyed by Deed by William Holder and wife to Luke English on the first day of April 1865 and recorded in the Clerk’s office of the County of Broome on the 27th day of April 1865 on Libes AS of Deeds of page 48. I also give and bequeath to my daughter Fanny Kinyon that other tract or parcel of land situate in the town of Chenango, County of Broome and State of New York. Bounded as follows – Being part of the lot on one hundred and twenty one in the Grand Division of the Boston Purchase, so called. Beginning at Luke English North West corner from thence running South seventy-four degrees West two chains and ninety one links to the stake and stones,

Thence South fifty two degrees, East two chains and Eighty three links to a stake and stone, thence North Seventy-four degrees East one chain and fifty links to stake and stones, then North sixteen degrees and thence running West two chains to the fence of beginning containing my seventy rods of land more or less, being the same piece of land conveyed by Deed by Mary F. Edward to Luke English on the 29th day of April 1865 and recorded in the Broome County Clerk’s office on the 26th day of June 1865 in Libes 67 of Deeds at Page 93. .

13th I give and bequeath to my Wife Betsey English during her life time the use of all the rest and residue of my property – to be accepted by her in lieu of Dower or any other claim. .

14th I give and bequeath to my two sons Jerimiah English and George English each one half of all that portion both principal and interest, that I have set apart for the maintenance of my wife Betsey which they are to have after the decease of my wife Betsey, but in case I outlive my Wife Betsey, I give and bequeath to my two sons Jeremiah English and George English each one half of all the rest and residue of my property not herein before bequeathed. .

15th If the use of the property set apart for the maintenance of my wife Betsey is not sufficient for her support then she may use of the principal what is necessary for her support. .

Likewise I make, constitute and appoint Hiram King and my son George English to be executors of this my last Will and Testament, hereby revoking all former Wills by me made. .

In Witness Whereof I have hereunto subscribed my name and affixed my seal this Seventeenth day of Dec – in the year of our Lord one thousand eight hundred and sixty eight.

The above written testament was subscribed to the said Luke English in our presence and acknowledged by him to each of us and he at the same time, declared the above testament so subscribed, to be his last Will and Testament, and we at his request have signed our names as witnessed hereto, in his presence and in the presence of each other and written opposite our names our respective places of residence. .
